Its hard to say without actually seeing it, you could have it in pose mode when you export it, it might not be mapped to the armature properly or it might be just bad in general. The only way to tell is if I looked at it or someone else, its not something i could easily explain to you. But your best bet would be to not make a new post for this.
Maybe put the .blend file here, or send it to some one you that knows what there doing and someone you trust.

alright thanks and to late for new post already made one but can i send you the .blend file its not a new look its a new stance on the bike so the guy has better technique

I took a look and the weights are painted the way you want (a little sloppy looking but still good enough) but for some strange reason the vertex assignment is taking effect in game instead of the weight paints, you may need the expertise of P2sta. I looked at it for awhile but couldn't see anything wrong, it could be as simple as a tick box.

is there any suggestions to any check box that may help or a section that i could mess around with to see if that helps

if you use blender 2.6x then you need to export the rider in the T pose (reset position button)
also the armature ingame is the way it is, and you can't really edit pose of the rider without screwing him over. You can move things a little here and there, but if you are not sure what you are doing, you will end up with bad looking result.

Checked the blend file and I think the whole problem is you misunderstand the whole riders idea. The pose you set in blender has nothing to do with the pose riders have ingame (it is mostly used just to check how the weightdrawing works) MXS has the pose set as it is and the only one able to change it is jlv. You can edit the model (geometry) a little to change the pose a bit, but thats not really a good idea as you will probably end up with a screwed rider if you don't know exactly what you are doing
