The only way I think you shouldn't have to ask for permission is if its like a completely different track and nothings the same.

If there is something to work off of, aka a "base terrain" give credit when its due. If you didn't make a base terrain completely by yourself starting from a black/grey map, then it's not yours. Shoot even Store Brand items give credit to the original companies, its just common sense.
